Terms of Service
Last updated: October 6, 2026
1. What you're agreeing to
These terms govern your use of reviewkathy.com and your purchase of a ReviewKathy plan
(Starter, Growth, or Dominate). By submitting a form on this site or paying for a plan, you agree
to these terms. "You" means the business or individual purchasing or using the service; "we,"
"us," and "ReviewKathy" mean Skyview Business Consulting Inc..
2. The service
ReviewKathy provides physical NFC tap-to-review cards programmed to your Google review page,
along with (depending on your plan) review monitoring, AI-assisted review responses, Google
Business content and AI-visibility optimization, competitor monitoring, and multi-location
support. Exactly what's included on your plan is described on our pricing page at the time you
sign up.
3. Billing and cancellation
- The one-time setup fee is charged when you sign up and covers setting up your account. NFC
cards are ordered separately and charged at the per-card prices shown on our pricing page.
- The monthly subscription fee is billed in advance each month, starting on your signup
date, for the length of the 12-month term.
- Plans have a 12-month term, billed monthly in advance. To end a plan before the 12 months are up,
contact us; the early-termination terms in your agreement apply.
- When a plan ends, monitoring, response drafting, and optimization work stop as of the final
billing date. Ending a plan does not disable or deactivate the physical cards already delivered to you —
they keep working as tap-to-review cards even after you cancel.
- We don't offer refunds for partial months.
4. Your responsibilities
- You need an active Google Business Profile for your cards to point to. If you don't have one,
tell us before ordering and we'll help you set one up first.
- You're responsible for the accuracy of the business information you give us (business name,
category, location) — it's what the cards get programmed against and what the AI visibility scan
is run for.
- You agree to use the service only for your own legitimate business, not to impersonate
another business or mislead customers.
5. What we will never do — and what you agree not to ask us to do
This is the most important section of these terms, and it's non-negotiable:
- We will never build, offer, or configure any feature that filters, gates, or screens which
customers get shown the review card or review link based on how happy they seem. Every card
points every customer to the same public review page, regardless of their experience.
- We will never offer a discount, prize, or other incentive conditioned on a customer leaving a
positive review, or on leaving a review at all in exchange for something of value.
- We will not guarantee a specific star rating, review count, or AI mention for your business,
and no representative of ours is authorized to promise you one.
- If you ask us to build any of the above, we'll say no — this isn't a negotiable feature
request, it's how the service is built to comply with Google's policies and the FTC Rule on
Consumer Reviews and Testimonials (16 CFR Part 465).
5A. Reviews are a voluntary request: no pressure, just an ask
The cards, links and messages we provide are a simple, optional invitation for a customer to share an
honest review. You agree that you and your staff will:
- Ask every customer the same way, and never require, pressure, or rush anyone to leave a review,
including while they are at your location.
- Never offer or give money, discounts, free goods or services, entries or any other reward for a review,
or for changing or removing one.
- Never discourage negative reviews, never ask only customers you think are happy, and never write,
buy, or post reviews on a customer's behalf. Reviews by owners, staff or their family must clearly disclose that connection.
- Never threaten, harass or make legal demands against a reviewer to take a review down.
If you or your staff do any of these, you are doing so against these terms and our instructions, and you are
solely responsible for the consequences.
5B. Reputation tools and review disputes
- Our review-dispute tools only check whether a review appears to break a review site's own written rules (for example a
fake or off-topic review, a conflict of interest, harassment, personal information or spam). They give you a
suggestion and a draft. You decide, and nothing is flagged, posted or sent without your approval.
- Flags are made only through the review site's official channels. The review site alone decides whether to
remove anything. We do not promise removal, and honest negative reviews, even unfair ones, are generally not removable.
- You are responsible for confirming the facts before you flag a review or publish a reply, including checking your
own records. Public replies we draft are suggestions; you are the publisher.
- Any "what customers say" page or website strip we provide shows real reviews, displays a selection that is labeled as a selection,
and shows the overall rating and count. You agree not to present that selection as every customer's experience.
- We are not a law firm and do not give legal advice. For a defamation or other legal matter, talk to your own attorney.
5C. Third-party platforms
Google and other review sites are independent. We do not control, and are not responsible for, their rules, algorithms, enforcement,
removal or restoration of reviews, rankings, listing suspensions, or changes to their policies or availability.
5D. Our right to refuse or suspend
We may decline a request, pause a feature, or suspend or end the service if we reasonably believe you or your staff are violating Section 5, 5A or 5B,
the law, or a platform's rules. Fees already paid are not refunded in that case, and the early-termination terms still apply.
6. Intellectual property
The ReviewKathy name, logo, and platform are our property. Reviews your customers write remain
their own words; you and we may both use them in accordance with the platform each was posted on
(e.g., Google's terms for Google reviews) and applicable law.
7. Disclaimers
The service is provided "as is." We don't guarantee any specific business outcome — review
count, star rating, AI visibility, or revenue — because those depend on factors outside our
control, including your own customer volume and market. Statistics referenced on our marketing
pages are third-party research about consumer behavior generally, not a promise about your
results.
8. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from
the service is limited to the amount you paid us in the 12 months before the claim arose. We are
not liable for indirect, incidental, or consequential damages, including lost profits or lost
business opportunities.
8A. Indemnification
You agree to defend, indemnify and hold harmless Skyview Business Consulting Inc., its owners, officers, employees, sales representatives and partners from claims,
penalties, losses and reasonable attorney fees arising from: (a) your or your staff's violation of Section 5, 5A or 5B, or of any law or review-site rule;
(b) information, content, instructions or approvals you give us; (c) your messages to customers, including text and email consent rules; or (d) the
replies, flags and posts you choose to make or approve.
8B. Relationship of the parties
We are an independent service provider. We are not your agent, employee, attorney or advisor, and we do not act for you on any review
platform unless you give us access and approve each action. No sales representative or partner can change these terms, make promises
about ratings, rankings, review removal or results, or approve any activity prohibited by Section 5, 5A or 5B.
9. Changes to these terms
We may update these terms from time to time. If we make a material change, we'll update the
date at the top of this page and notify active customers by email.
10. Governing law and disputes
These terms are governed by the laws of the State of Wisconsin, without regard to its
conflict-of-law principles. Any dispute arising from these terms or the service will be resolved
in the state or federal courts located in Washington County, Wisconsin, and you consent to that
venue and jurisdiction.
10A. General
These terms and your signup form are the entire agreement between us on this service. If any part is found unenforceable,
the rest stays in effect. Our failure to enforce a term is not a waiver of it. You may not assign these terms without our written consent.
